本文在上节中谈到的所有有关枫叶卡的法律条款中，比较重要的一条是A28条。其中A28（1）规定，一个长久移民必须在每个5年中满足居住期的责任。

原文如下：

Residency obligation

28. (1) A permanent resident must comply with a residency obligation with respect to every five-year period.

A28（2）接着对居住期的责任进行了详细的阐述：如果一个长久移民在每5年的730天中，满足下列条件，即满足了A28（1）中的规定：

1）  居住在加拿大；

2）  在加拿大以外的国家陪同具有加拿大公民资格的配偶或不成文法夫妻。如果是儿童，需在国外跟随父母；

3）  在加拿大以外的国家全职受雇于加拿大的企业，加拿大联邦政府，或加拿大省政府；

4）  在加拿大以外的国家陪同具有长久移民资格的配偶或不成文法夫妻，并且其配偶或不成法夫妻受雇于加拿大海外的企业，加拿大联邦政府或加拿大省政府。如果是儿童，陪同满足上述条件的父母；或

5）  IRPR条款中提到的用其他方式满足了居住期责任的人士。

Application

(2) The following provisions govern the residency obligation under subsection (1):

(a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are

(I)  physically present in Canada,

(ii)  outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent,

(iii) outside Canada employed on a full-time basis by a Canadian business or in the federal public administration or the public service of a province,

(iv) outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent and who is employed on a full-time basis by a Canadian business or  in the federal public administration or the public service of a province, or

(v)  referred to in regulations providing for other means of compliance。

         这些条款看似简单，其实则不然。比如，根据上述(iii) 条款，一个长久移民在加拿大落地以后，建立一个公司，然后再在中国建立一个办事处，并在这个办事处工作，好像便可满足居住期的要求。事实上，一些对加拿大法律不甚了解的中介也是这样为许多长久移民规划的。那么，这样做真的会达到预期的目的吗？我将在下一节中详细回答这个问题。
